Before the jury entered, Judge Willis questioned juror Laura Barber about a citizen’s report concerning an evening at the Manitowoc Eagle’s Club. Barber said she had not discussed the case or expressed her views. The court later instructed jurors on the three remaining charges, explaining that the false-imprisonment count had been dismissed. The instructions addressed reasonable doubt, the defense’s framing theory, and Avery’s decision not to testify. In closing, Kratz argued that the RAV4, burn-area recoveries, witness accounts, and DNA evidence supported the State’s case. Buting disputed the proposed burn-site inference, accepted the attribution of blood in the RAV4 to Avery while questioning how it got there, and challenged the garage bullet’s DNA result.
