On Day 19 of Steven Avery's 2007 trial, defense witness Debra Kakatsch, the Manitowoc County coroner, described her training and her office's death-investigation duties. She said she first learned from television of reports of suspected bones on or near the Avery property, had not previously been involved in the investigation into Teresa Halbach's disappearance, and then received calls from deputy coroners about a plan of action. Her examination stopped before she explained that plan.
Defense counsel proposed further testimony that Kakatsch had been kept from the suspected-remains investigation, arguing that it bore on investigative bias and recovery practices. The State challenged its relevance. After an oral offer of proof, the court found little probative value and a risk of confusing the jury, and did not allow the proposed testimony on the record then before it. The court left open reconsideration if later defense testimony supplied additional relevance.
