Terri Temme served as a juror in Steven Avery's 2007 trial. On Day 9, she alerted the court that she had recognized Detective Dave Remiker, a trial witness, as someone involved in an earlier civil case on which she had served as a juror. The judge questioned her about what she remembered and whether that experience would affect her service, then instructed her not to discuss the matter or the questioning with other jurors.
The defense moved to strike Temme for cause, arguing that her participation in a verdict awarding Remiker damages created an appearance of bias. The State disagreed. The judge credited Temme's voluntary report and her account that she did not remember whether Remiker had testified in the earlier case, found no indication that the experience inclined her toward him, and denied the motion.
Temme was later called for an individual seated-juror inquiry on Day 21. Before the jury completed closing arguments, the parties agreed to use additional peremptory strikes rather than draw alternate jurors by lot. The judge identified Temme and Laura Barber as the jurors to be excused and barred media access to them until a verdict because they might be recalled.
