MR. KRATZ: Uh, we can certainly set the date, Judge. There are two requests that I would make. First, I would ask the Court, uh, order a, uh, presentence, uh, investigative report. I'm sure, uh, that, uh, will be done as a matter of course.

Secondly, given the nature of the, uh, convictions, uh, and although, uh, the bond and bail that has been set in this case, uh, is, uh -- is rather high, uh, given the mandatory : sentence, uh, that is, uh, necessary and imperative in this case, uh, I would ask that the Court, uh, revoke bail at this time.

THE COURT: Defense wish to be heard?

MR. FREMGEN: No, Judge.

THE COURT: All right. The -- the Court will, for the -- the reasons stated by the prosecutor, revoke the bail in this case. Court will order that a presentence investigation be completed by July 9, 2007. I would like to set sentencing for July 17, 2007, and this assumes that your calendars are open on that day.

MR. FREMGEN: Judge, I have a two-day trial Monday and Tuesday of that week.

THE COURT: Your calendar's not open.

MR. FREMGEN: It is not open.

THE COURT: All right.

MR. KRATZ: Perhaps the week before that, Judge. I know at the end of July I have a, um -- a week-long arson trial. But if the Court could set it, perhaps -- uh, maybe move up the, uh -- the PSI and set it for the second week of July.

THE COURT: Uh, the difficulty is in moving up the PSI.

MR. KRATZ: I understand.

THE COURT: I -- I -- I'm sort of cutting it close on that one in the first instance. I could certainly set, uh -- set it either later on in July toward the absolute end or the beginning of August if that's --

MR. KRATZ: The first couple of days of August would be just fine, Judge.

THE COURT: How about Monday, August 6?

MR. FREMGEN: That's fine.

THE COURT: Nine o'clock a.m.?

MR. FREMGEN: That's fine.

MR. KRATZ: August 6 at 9?

MR. KRATZ: That will work out fine. Thank you, Judge.

COURT CLERK: Do you still want the PSI to be done by July --

THE COURT: Actually, we can move the PSI, uh, to the --

MR. KRATZ: Sixteenth maybe? That's a week later.

THE COURT: Yeah. The 16th, uh, is a Saturday, so -- Well, that's June. Excuse me. Uh, yeah, 16th is a Monday. That's fine. PSI will be due then on the 16th.

COURT CLERK: Do you want an order drafted on the bail revocation?

THE COURT: The State will draft the order on the bail modification.

MR. KRATZ: I will, Judge.

THE COURT: Sentencing, 9:00, uh, August 6. Anything more to come before the Court this evening?

MR. KRATZ: Not today, Judge, thank you.

MR. FREMGEN: No, Judge.

THE COURT: Good evening, then.
